This online portal and website (Adviser Portal) are owned and operated by MLC Limited ABN 90 000 000 402 AFSL 230694 (MLC Life Insurance). The terms ‘our’, ‘we’ and ‘us’ refer to MLC Life Insurance, and the terms ‘you’ or ‘your’ refer to the individual accessing these terms and conditions.

Your use of the Adviser Portal is governed by these terms and conditions, the Terms of Use, Security terms and our Privacy Policy (together, the ‘Terms’). Acceptance of the Terms is required to register for and use the Adviser Portal.

Adviser Responsibilities

You may only take actions that are authorised by your client.

You must keep your user name and password and Adviser Code (credentials) confidential, only you may access the Adviser Portal with these credentials. Access to the Adviser Portal using your credentials and any subsequent instruction or transaction will be deemed to be a valid instruction or transaction by you.

You authorise us to act upon any transaction or instruction processed on the Adviser Portal using your credentials. Acceptance of any transaction or instruction processed by you (including on behalf of your client) is at MLC Life Insurance’s discretion. You must notify us immediately if you become aware or you reasonably suspect that your credentials have been compromised or there has been unauthorised access to the Adviser Portal. You will be responsible and liable for any action taken using your credentials. You will not be responsible or liable for any action taken using your credentials:

• after you have notified us that your credentials have been or may have been compromised; and
• you were not responsible for the unauthorised disclosure of or access to your credentials.

We may deny or withdraw your access to the Adviser Portal where we have concerns about the security of your credentials, or we otherwise have concerns regarding the availability, security or integrity of the Adviser Portal in connection with your use and access.

You agree to indemnify us and all other users of the Adviser Portal and any linked MLC Life Insurance websites or systems against any loss, damage, cost or expense suffered or incurred arising from the use of the Adviser Portal and MLC Life Insurance website by you, any person on your behalf or any other person using your credentials.

Your Support Staff

If you allow your support or administrative personnel (Personnel) to access the Adviser Portal, and/or to receive or access information, or provide instructions to MLC Life Insurance on your behalf, you agree that they do so on behalf of you and your business and that any transactions or instructions initiated by your Personnel will be deemed to be initiated by you. You agree that any Personnel who accesses the Adviser Portal may access all information available to you.

Products and Services

Unless stated otherwise, the products and services described on the Adviser Portal and the MLC Life Insurance website are issued by MLC Limited ABN 90 000 000 402 AFSL 230694.

MLC Life Insurance has an arrangement with NULIS Nominees (Australia) Limited ABN 80 008 515 633 AFSL 236465 (NULIS Nominees), who is the Trustee of the MLC Super Fund (the Fund) ABN 70 732 426 024 to issue products through the Fund.

Unless specifically stated otherwise, the products, services and information on the Adviser Portal and MLC Life Insurance website are prepared for Australian residents only.

You should review all statements carefully and immediately notify us of any errors or omissions. We’ll keep computer records of the online communications between you and us, including your instructions and our responses, and the time of these communications. Unless there is an obvious error, these records will be conclusive and you agree that the records may be used as evidence in the event of dispute. You also agree that we may record telephone conversations which may be used as evidence in the event of dispute.

Your Information

Personal information of you, your Personnel and your clients will be treated in accordance with our Privacy Policy. You acknowledge that we may share information regarding your business relationship with MLC Life Insurance with third parties who conduct industry analysis and market research or assist us with our product and channel research, development and planning.

Changes to Terms

The Terms are accessible in the footer of the Adviser Portal and on the MLC Life Insurance website. We may update the Terms from time to time and you should check the Terms regularly for changes. You acknowledge that by making the Terms accessible to you we have provided you with sufficient notice of any changes, and your continued use of the Adviser Portal will confirm your acceptance of the then published Terms.
