We’ve clarified some definitions

We recently revised some of the terms we use in our policies to make them clearer. This page lists the definitions we’ve updated for each insurance product, side by side with the previous version. It also sets out important information to help you understand some of the key limits that may apply to your policy, depending on the type of insurance you have.

If you’re not sure which insurance product and type you have, please check your most recent policy schedule.

If you need to make a claim, we’ll apply these definitions, unless the previous definitions create a better outcome for you. Otherwise, the terms and conditions of your policy remain unchanged.

  • MLC Insurance and MLC Insurance Super (MLCI and MLCIS)

    Doctor Means a registered medical practitioner in Australia or in another country approved by us. This does not include you or any of your family members. Where reasonable, we require the Doctor to be a Specialist.

    Doctor means a person who is registered in Australia as a medical practitioner by the Medical Board of Australia or a medical practitioner with qualifications equivalent to Australian medical practice or registration standards if practising outside Australia. Medical practitioner does not include:

    • you;
    • your business partner; or
    • your Immediate family members.

    Where reasonable, we require the Doctor to be a Specialist, particularly if the condition is more commonly diagnosed and treated by a Specialist. Note – a chiropractor, psychologist, physiotherapist and/or allied or alternative health provider is not a medical practitioner unless registered as a medical practitioner by the Medical Board of Australia.

    Home Duties

    TPD – Home Duties

    If the Life Insured was performing full time domestic duties or child rearing and these three criteria apply:

    • at the time of application for insurance, and
    • for the 12 months prior to the disability, and
    • at the time the disability begins,

    the Life Insured is Totally and Permanently Disabled if they have a disability caused by sickness or injury and they satisfy the criteria in paragraphs (a),(b) or (c):

    (a)

    • as a result of their disability they are completely unable to perform any Normal Physical Domestic Duties, and are unlikely ever to be able to do so again; and
    • these circumstances have existed
    • continuously for at least 3 months,

    or

    (b)

    • they suffer a permanent impairment of at least 25% of Whole Person Function; and
    • as a result of this impairment, they are disabled to such an extent that they are completely unable to perform any Normal Physical Domestic Duties, and are unlikely ever to be able to do so again,

    (c) they have suffered from the total and irrecoverable loss of:

    • the use of both hands; or
    • the use of both feet; or
    • the sight in both eyes; or
    • the use of one hand and one foot; or
    • the use of one foot and the sight in one eye; or
    • the use of one hand and the sight in one eye.

    In all cases, where the Policy is owned by the trustee(s) of a superannuation fund and this Total and Permanent Disability insurance first commenced after 30 June 2014, the Life Insured must also be Permanently Incapacitated.

    Normal Physical Domestic Duties means cleaning, cooking meals, doing the laundry, shopping for groceries and taking care of Children.

    If the Life Insured was not performing full time domestic duties or child rearing within the three criteria referred to above, the Any Occupation Definition will apply.
     

    TPD – Home Duties

    If the Life Insured was performing full time domestic duties or child rearing:

    • at the time of application for insurance, and
    • for the 12 months prior to the disability, and
    • at the time the disability begins,

    the Life Insured is Totally and Permanently Disabled if they have a disability caused by sickness or injury and they satisfy the criteria in paragraphs (a),(b) or (c):

    (a)

    • as a result of their disability they are completely unable to perform a majority of the Normal Physical Domestic Duties, and are unlikely ever to be able to do so again; and
    • these circumstances have existed continuously for at least 3 months,

    or

    (b)

    • they suffer a permanent impairment of at least 25% of Whole Person Function; and
    • as a result of this impairment, they are disabled to such an extent that they are completely unable to perform a majority of the Normal Physical Domestic Duties, and are unlikely ever to be able to do so again,

    (c) they have suffered from the total and irrecoverable loss of:

    • the use of both hands; or
    • the use of both feet; or
    • the sight in both eyes; or
    • the use of one hand and one foot; or
    • the use of one foot and the sight in one eye; or
    • the use of one hand and the sight in one eye.

    In all cases, where the Policy is owned by the trustee(s) of a superannuation fund and this Total and Permanent Disability insurance first commenced after 30 June 2014, the Life Insured must also be Permanently Incapacitated.

    Normal Physical Domestic Duties specifically include:

    • cooking and preparing meals – meaning the ability to prepare meals using kitchen appliances
    • cleaning the home – meaning the ability to carry out the basic internal household chores using domestic equipment such as a vacuum and mop
    • washing clothes – meaning the ability to do the household’s laundry
    • shopping for groceries – meaning the ability to purchase general household grocery items (excluding online shopping),
    • safely driving a car – the physical ability to drive a car, and
    • caring for Children – meaning the ability to care for and supervise Children (where applicable).

    You will be considered to be unable to carry out Normal Physical Domestic Duties if you are unable to perform four or more of these duties.

    Multiple Sclerosis

    Multiple Sclerosis – of specified severity

    The progressive destruction of the insulating layer of myelin in the brain and spinal cord. The unequivocal diagnosis of Multiple Sclerosis must be by a consultant neurologist. There must be more than one episode of defined neurological deficit with persistent abnormalities. Neurological investigation such as lumbar puncture, MRI (Magnetic Response Imaging), evidence of lesions in the central nervous systems and evoked visual responses are required to confirm diagnosis.

    Multiple Sclerosis – of specified severity

    The progressive destruction of the insulating layer of myelin in the brain and/or spinal cord. The unequivocal diagnosis of Multiple Sclerosis must be by a consultant neurologist. There must be more than one episode of defined neurological deficit with persistent abnormalities.     Total & Permanent Disability (TPD) and Critical Illness Stand Alone Survival Period

    A key limitation of TPD and Critical Illness standalone insurance is:

    • The full benefit will only be paid if the claimant survives for more than 14 days after an insurable event. Where the claimant dies within 14 days of an insurable event, a $5,000 Death Benefit will be paid instead.

    Please be reminded of the following limitation of the TPD and Critical Illness Stand Alone insurance:

    • A $5,000 Death Benefit will be paid if the claimant dies within 14 days of an insurable event
    • The full benefit will only be paid if the claimant survives for more than 14 days after an insurable event

    In 2019, MLC added additional wording to the MLCI and MLCIS Product Disclosure Statement for TPD and Critical Illness Stand Alone insurance to clarify this limitation.

    Please be reminded of the following limitation of the Critical Illness Stand Alone insurance:

    • A $5,000 Death Benefit will be paid if the claimant dies within 14 days of an insurable event
    • The full benefit will only be paid if the claimant survives for more than 14 days after an insurable event

    In 2019, MLC added additional wording to the PPP & LCS Supplementary Product Disclosure Statement for Critical illness Stand Alone insurance to clarify this limitation.

If your occupation immediately before the start of Total and Permanent Disability can be described as ‘Home Duties’, then Total and Permanent Disability shall mean that you have, for an uninterrupted period of three months, been under medical supervision with complete inability to perform the majority of normal domestic duties. And we also believe that, after consideration of medical and any other evidence, you are unlikely ever to recover

    Home duties means you have been engaged in full-time normal domestic duties in your own residence for more than six months.
